Gushi — Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Gushi (the “App”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the App.

By using the App, you acknowledge that it is provided for general entertainment purposes only, that it is not intended to provide medical, psychological, or professional advice, and that you assume full responsibility for your use.

2. Eligibility

Gushi is intended for caregivers and children under their supervision. You must be at least 18 years old (or have parental permission) to accept these Terms on behalf of a minor.

3. Content Ownership & Limited License

All images, audio, text transcripts, animations, and other content in the App (“Gushi Content”) are owned by Space Noodle LLC or its licensors. We grant you a personal, non-exclusive, revocable license to stream or download Gushi Content solely for in-app, non-commercial use.

You may not copy, save, export, publish, transmit, or otherwise redistribute any Gushi Content outside the App without prior written consent.

All Gushi Content is provided for general entertainment purposes only and may not be relied upon for educational, medical, or therapeutic purposes.

4. Permitted & Prohibited Uses

• Permitted: Streaming stories for personal or household listening; setting favorites; submitting optional feedback or bug reports.
• Prohibited: Reverse engineering, scraping, or interfering with the App; redistributing or commercializing Gushi Content; violating any applicable laws.

Gushi stories and features are intended to promote relaxation and entertainment, not to diagnose, treat, or prevent any condition.

5. Subscriptions & In-App Purchases

Some features (for example, full library access and new features) require a paid purchase. Pricing, billing cycles, and renewal terms are shown in-app before you purchase. All sales are final except where required by law. A limited free tier provides access to one story from the library.

5.1 Gushi Premium Monthly (auto-renewing subscription — $3.99 USD)

• Term & Price: 1-month term at $3.99/month (USD) plus applicable taxes. Local currency varies as shown on the purchase screen.
• Billing & Renewal: Charged to your Apple ID at confirmation. Auto-renews each month unless you cancel at least 24 hours before the current period ends. Your account may be charged for renewal within 24 hours prior to period end.
• Access: Full library, unlimited listening, and new stories and features as released during your active subscription.
• Manage/Cancel: iOS Settings → your name → Subscriptions, or apps.apple.com/account/subscriptions.
• Refunds: Handled by Apple under App Store policies.
• Price Changes: If pricing changes, Apple may notify you and you can review and cancel before the next billing cycle.

5.2 Gushi Premium Annual (auto-renewing subscription — $29.99 USD)

• Term & Price: 12-month term at $29.99/year (USD) plus applicable taxes.
• Billing, Renewal, Access, Manage/Cancel, Refunds, Price Changes: Same as Section 5.1, adjusted for an annual term.

5.3 Gushi Premium Lifetime (limited-time, one-time purchase — $59.99 USD)

• Price: $59.99 USD plus applicable taxes.
• Access: Same feature access as Premium subscriptions. “Lifetime” means the lifetime of the App—for as long as Space Noodle LLC continues to make Gushi available.
• Availability: Offered for a limited time and in limited quantity. Purchases at this price are grandfathered and will retain Lifetime access under the definition above.
• Refunds: Handled by Apple under App Store policies.

5.4 General

Features and content may evolve over time; library size and feature set may change, and pricing may be updated in the future.

Taxes, fees, and availability may vary by region.

Your use of the App remains subject to these Terms and our Privacy Policy.

6. Feedback

If you submit comments or bug reports, you grant Space Noodle LLC a perpetual, worldwide, royalty-free license to use that feedback to improve the App Supplying an email address is optional and governed by our Privacy Policy.

7. Disclaimers

The App and Gushi Content are provided “as is” and “as available,” without warranties of any kind.

• Entertainment Only. Gushi is designed for relaxation, storytelling, and entertainment. It is not a substitute for professional medical, psychological, educational, or parenting advice.
• No Warranties. Space Noodle LLC does not guarantee that the App or its content will be uninterrupted, error-free, or free of harmful components.
• Assumption of Risk. By using the App, you understand and agree that you do so voluntarily and at your own risk.

8. Limitation of Liability

To the maximum extent permitted by law, Space Noodle LLC and its officers, directors, employees, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, goodwill, or other intangible losses, arising out of or related to your use of the App or any Gushi Content.

If liability cannot be excluded under applicable law, it will be limited to the amount you paid (if any) for access to the App during the twelve months preceding the event giving rise to the claim.

No Legal Claims Clause. By using the App, you waive any right to bring claims or actions relating to emotional, behavioral, or developmental outcomes allegedly caused by use or misuse of Gushi stories.

8.1 Parental Responsibility

Caregivers are solely responsible for supervising minors’ use of the App and determining whether the stories and features are appropriate for their child. Space Noodle LLC disclaims all responsibility for the actions or interpretations of minors using the App without adult supervision.

9. Termination

We may suspend or terminate access to the App at any time for violation of these Terms. You may stop using the App at any time.

10. Governing Law; Dispute Resolution; Arbitration; Venue

These Terms are governed by the laws of the State of California, U.S.A., without regard to its conflict-of-law rules. If you are a consumer, you also retain any non-waivable protections afforded by the laws of your state of residence.

Informal Resolution First. Before filing a claim, you agree to contact us through the Gushi support page at https://gushi.spacenoodle.ai/support with a summary of the dispute and your requested resolution. If we cannot resolve it within 30 days, either party may proceed as set out below.

Binding Arbitration; Class-Action Waiver This dispute-resolution process is your exclusive means of resolving any dispute with us arising out of or relating to your use of the App. Except for the matters carved out below, any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved by binding arbitration on an individual basis under the AAA Consumer Arbitration Rules. The arbitrator may award individual relief available in court. You and the Company waive any right to a jury trial and to participate in a class, collective, consolidated, or representative action.

Seat, Rules, and Venue. The seat and venue of arbitration will be San Francisco County, California. At your election and where permitted by the AAA rules, hearings may be conducted by video or on the papers. California law will apply consistent with the “Governing Law” section.

Small-Claims and Limited Court Relief. Either party may bring an individual claim in small-claims court in your county of residence or in San Francisco County, California. In addition, either party may seek temporary injunctive relief in a court of competent jurisdiction in San Francisco County, California, to protect intellectual-property or confidential-information rights pending arbitration.

Public-Injunctive Relief (California Notice). To the extent required by California law, claims for public injunctive relief may be brought in court and stayed pending arbitration of all arbitrable issues.

30-Day Opt-Out. You may opt out of this arbitration agreement (but not the governing-law or forum provisions) through the Gushi support page at https://gushi.spacenoodle.ai/support within 30 days after you first accept these Terms.

Time Limit to Bring Claims. To the maximum extent permitted by law, any claim must be filed within one (1) year after it first could be brought; otherwise it is permanently barred.

Severability. If the class-action waiver is found unenforceable as to a particular claim, that claim must proceed in court (not arbitration) in San Francisco County, California. If any other portion of this section is found unenforceable, it will be severed and the remainder enforced.

11. Changes to These Terms

We may update these Terms to reflect new features or legal requirements. When we do, we will post the revised Terms in-app and highlight key changes for at least seven days. Continued use of the App after changes take effect constitutes acceptance.
